Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the MarginMax Solutions website, our communication channels (phone, SMS, email), and the consultation and operations services we provide. By submitting our consultation form, calling our business line, texting our business number, or engaging us as a paying client, you agree to these Terms.

SMS messaging program
Program name: MarginMax Solutions Customer Communications.
Program description: MarginMax Solutions sends SMS messages to prospects and clients who have opted in. Messages include consultation scheduling, appointment confirmations and reminders, missed-call follow-ups, account and billing notifications, and conversational replies from our team.
How you opt in:
- By checking the SMS consent box on the consultation form at marginmaxsolution.com/consultation. The checkbox is unchecked by default. Checking it confirms your agreement to receive SMS messages from MarginMax Solutions at the phone number you provide.
- By calling our business number. If we are unavailable and you leave a callback request, we may send a one-time SMS response.
- By texting our business number first. Replying to your message is part of the conversation you initiated.
Message frequency: Message frequency varies based on your interaction with us. You will typically receive between 1 and 10 messages per month.
Message and data rates: Message and data rates may apply, depending on your mobile carrier and plan. MarginMax Solutions does not charge you for SMS messages.
How to get help: Reply HELP to any message for assistance. You may also email DonM@marginmaxsolution.com or call +1 (973) 222-8692 for support.
How to opt out: Reply STOP to any message at any time. You will receive a single confirmation message and no further texts will be sent. You may also reply STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to opt out.
Carriers: Carriers (AT&T, T-Mobile, Verizon, and others) are not liable for delayed or undelivered messages.
We will never share your phone number, SMS opt-in records, or consent details with third parties for their marketing purposes. Phone numbers collected for SMS communication are used solely by MarginMax Solutions LLC and the messaging carriers required to deliver the messages.
Phone calls and AI-assisted communications
When you call our business number, your call may be recorded for quality, training, and record-keeping. If your call is not answered live, an AI voice receptionist may answer in our place. The AI receptionist identifies itself as an automated assistant. The conversation is recorded and transcribed by automated systems. Consultation requests
Submitting the consultation form is a request for a conversation about our services. It is not a contract, a commitment to purchase, or a binding offer. We will follow up by your preferred method to discuss whether we are a good fit. Either party may decline to proceed at any time.
Paid services
If you engage MarginMax Solutions for paid services, the specific deliverables, pricing, payment schedule, term length, and cancellation terms will be set out in a separate written agreement (a Statement of Work, Service Agreement, or similar). The provisions of that written agreement control over these Terms with respect to the paid engagement. In the absence of a separate written agreement, the following baseline terms apply:
- Billing. Recurring services are billed monthly in advance through Stripe. One-time services are billed at the start of the engagement.
- Cancellation. You may cancel a recurring service at any time with 30 days' written notice. Cancellation does not entitle you to a refund of fees already paid for the current billing period unless otherwise agreed in writing.
- Refunds. Fees paid are non-refundable except where MarginMax Solutions fails to deliver agreed-upon services and the failure is not cured within a reasonable time after written notice.
- Out-of-pocket costs. Per-message SMS carrier fees, A2P 10DLC campaign fees, third-party software subscriptions, and similar pass-through costs are billed at cost or as set out in the written agreement.
Acceptable use
You agree not to use our website, services, or communication channels to:
- Violate any applicable law, including telecommunications, privacy, marketing, and consumer-protection laws.
- Send unsolicited marketing messages or spam through any system we operate on your behalf.
- Impersonate any person or misrepresent your affiliation with any person or organization.
- Attempt to gain unauthorized access to our systems or interfere with their operation.
- Use our services to harass, threaten, defame, or harm any person.
Intellectual property
The MarginMax Solutions name, logo, website content, written materials, software, workflows, and methods are the property of MarginMax Solutions LLC. You may not copy, redistribute, or create derivative works from these materials without our written permission. Content you submit to us through the consultation form, by phone, or by SMS remains your property; you grant MarginMax Solutions a limited license to use it for the purpose of providing services to you.
No warranties
Our website and services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, MarginMax Solutions disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website or services will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the maximum extent permitted by law, MarginMax Solutions LLC, its members, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, services, or communication channels. Our total cumulative liability for any claim arising out of or related to these Terms or our services is limited to the amount you paid MarginMax Solutions in the three months immediately preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
Indemnification
You agree to indemnify and hold harmless MarginMax Solutions LLC from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party right.
Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms will be brought exclusively in the state or federal courts located in Sussex County, New Jersey, and you consent to the personal jurisdiction of those courts.
Changes to these Terms
We may update these Terms as our services change or as required by law. The effective date at the top of this page will be updated whenever changes are made. Continued use of our website or services after the effective date constitutes acceptance of the updated Terms.
